Supreme Court rules against INTI appeal

(El Universal) - "The Supreme Court ruled against the National Land Institute (INTI) and in favour of the owners of cattle ranch La Candelaria in Zulia state.

The highest court ruled in this case which began its proceedings in October 2003. The owners of cattle ranch La Candelaria had asked Zulia's Higher Land Tribunal for an habeas corpus after INTI granted provisory titles over this property, to a group of people without following the corresponding procedures.

After this request, the Land Tribunal ruled in favour of the owners of ranch La Candelaria and instructed INTI to re-establish ownership of those lands (...)

This sentence from the Constitutional Tribunal of the Supreme Court also mentions other decisions which have been made regarding this matter, proclaiming in favour of private owners of agricultural lands who had requested habeas corpus because proceedings were not correct (...)

The sentence also expressed that 'the balance between the constitutional rights to economy and property, and the state intervention with public purposes enunciated in article 305 of the Constitution of the Bolivarian Republic of Venezuela and the Land Decree (...) is achieved through the implementation, among other principles, of the legality of land limits; confiscation banning; compensation for sacrifices and damages imposed or caused to the property, and respect to due process for its extinction or definite restriction".
